What I got from Alito's opinion was that he compared apples and oranges. He said that to allow blacks to retain jobs with less seniority than whites was akin to letting a ball player hit homeruns by "moving the parameters each time he was at bat". This made me think that there is something very wrong with Alito's brain.

Moving a parameter for a homerun speaks to the merits or quality of play: the ability of the homeruns to be hit is enhanced by varying the field or cheating. Keeping staff due to race and not seniority has nothing to do with the merits or quality of "play" of teaching ability.

It is to keep minority leadership on hand in a good proportion to the student population is an important tool in advancing minorities as needing role models.

Alito was way off here.
